These Terms of Use (“Terms”) govern your access to and use of the websites operated by Adventure Imports, LLC, including Overland Kitted (collectively, the “Site”), and your purchase or use of products and services available through the Site (“Services”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site immediately.

1. ACCEPTANCE OF TERMS
We may update these Terms at any time by posting the revised version to the Site. Your continued use of the Site constitutes acceptance of any updated Terms. You are responsible for reviewing these Terms periodically.

We reserve the right to refuse service, cancel orders, or block access for violations.
3. ACCOUNT SECURITY
If you create an account, you are responsible for maintaining the confidentiality of your login information and all activity under your account. We are not liable for unauthorized access caused by failure to secure your credentials.
4. INTELLECTUAL PROPERTY
All content, logos, images, product descriptions, and design elements on the Site are the property of Adventure Imports, LLC or its partners. They are protected by U.S. and international copyright laws. You may not copy or use Site content for commercial purposes without written permission.
Personal, non-commercial use is permitted.
5. PRODUCT AVAILABILITY, PRICING, AND ORDERS

We strive for accuracy, but errors may occur. Product details, colors, or finishes may vary due to manufacturer updates or display differences.
5.2 Availability
Some products are made to order, custom-built, or shipped from partner manufacturers. We reserve the right to:
• Cancel unavailable items
• Notify you of backorders or delays
• Limit quantities
5.3 Pricing and Errors
All prices are listed in U.S. dollars and may change without notice.
We reserve the right to correct pricing errors and cancel any order placed with incorrect pricing.
5.4 Order Acceptance
An order confirmation does not guarantee acceptance. We may refuse or cancel orders at our discretion, including for suspected fraud or policy violations.
6. PAYMENT AND FRAUD PREVENTION
We use secure third-party processors for payments. By submitting payment, you confirm authorization to use the selected payment method.
We may request additional verification for large, freight, or high-risk orders.
Common fraud we protect against includes:
• Return fraud (returning used, swapped, or installed items)
• Chargeback fraud
• False damage claims
• Invalid or intentionally incorrect shipping addresses
• Warranty abuse
• Bot purchases or card testing
• Creating multiple accounts to abuse discounts
We cooperate with law enforcement when necessary.
7. SHIPPING, RETURNS, AND WARRANTIES
By using the Site, you acknowledge and agree to our Shipping Policy, Return Policy, and Warranty Policy (manufacturer-based). These policies outline freight inspection requirements, damage reporting windows, and other obligations you must follow.
8. THIRD-PARTY FULFILLMENT AND LINKS
Some items ship directly from manufacturers or authorized partners. We are not responsible for delays caused by third-party schedules, carriers, or fulfillment centers.
The Site may include links to third-party websites. We do not endorse or control these sites and are not responsible for their content or practices.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Adventure Imports, LLC is not liable for:
• Indirect, incidental, punitive, or consequential damages
• Lost profits or lost data
• Delays or carrier errors
• Product misuse or improper installation
• Errors or inaccuracies in product listings
Our total liability is limited to the amount you paid for the product at issue.
Some jurisdictions do not allow certain limitations. In such cases, liability is limited to the maximum extent permitted by law.
10. INDEMNIFICATION
You agree to indemnify and hold harmless Adventure Imports, LLC and its employees, contractors, and representatives from any claims, damages, or losses resulting from your use of the Site, your breach of these Terms, or fraudulent conduct.
11. PRIVACY
Your use of the Site is governed by our Privacy Policy. We do not sell personal information. We may share necessary data with payment processors, shipping carriers, and manufacturers to fulfill orders.

12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Arizona.
Disputes must first be addressed through good-faith negotiation. If unresolved, disputes will be handled through binding arbitration in Yavapai County, Arizona.
You agree not to participate in class-action claims against Adventure Imports, LLC.
13. TERMINATION
We may suspend or terminate your access to the Site at any time for violations of these Terms or suspected fraudulent activity. We may cancel or refund orders at our discretion.
